Can a person rent out their house if it is being forclosed and can they have a legal bonding rental agreement.

You cannot prevent a foreclosure by renting out the house. If the rent is sufficient to allow you to clear up the delinquency which led to the foreclosure, you might try to stop the foreclosure by contacting the lender and working out an agreement.

You can still have a legally binding lease agreement. The owner can could cure the default.
