my father has just passed away and my sisters are fighting over the estate, what percentage is the stardard that the lawyer will take from the estate?

There is no standard fee, however Maryland law requires that the attorney get the permission from the court or the permission from all the beneficiaries before paying him/herself out of the estate.

No legal fee is set by law, but generally the combination of attorney fees and personal representative commissions should be 3.6% of the estate (with a higher percentage of 9% for the first $20,000) unless there is some complicating factor necessitating more work than usual.

Clients should expect transparency in fees and no matter what the fee arrangement might be it is good to get this in writing before engaging counsel.
