Legal Question in Disability Law in Massachusetts

An insurance company is dragging out a settlement on a lawsuit because they have to offer the maximum amount of the insurance policy. If I have to sue to get this money, can I sue for the legal fees on top of the policy, or is the policy the absolute limit I can get from the insurance company?

My advice would be to prepare and file a Demand Letter to the insurance company alleging unfair settlement practices. That usually lights a fire under them. Note that your recovery is not limited to the responsible parties' insurance limits. You may have your own uninsured/under-insured motorist protection, and you can also go after the other driver personally for damages. The other thing you can do is simply file suit - nothing gets their attention like a lawsuit.
