Legal Question in Consumer Law in Massachusetts

I have been with ATT for several years now and recently I called them re: a phone issue...while i was talkin to there agent who tried to fix my phone he didnt fix the problem so he transfered me to someone else. While I was on the phone with the next agent I received a text message from a number Ive never seen..It was from the first agent I had spoke with who was flirting with me now through text messaging. I find it is a breach of ATT's privacy act. The male agent proceeded to text me all day and even texted a picture.. I called ATT and told them of this and after three phone calls finally something was done about it. They ended up firing him and told me it was a federal offense and I could press charges against him. I told them i dont feel comfrotable knowing someone went into my account and mis used my information and also could have gotten any other information on that account which he could now mis use! ATT told me that it is not a breach of privacy and I shouldnt worry about it. I just want to know if this is an actual breach of privacy and if I should get a lawyer or if I should let it go! Thank you!
