Legal Question in Credit and Debt Law in Massachusetts

Question about court hearing of deficiency

His car was towed on Jan 2008 because he couldn't make a payment on time. The reason was he lost a job. He tried to find a job but all failed until now. Last year, he heard that it is written off as bad debt. He was also told that the case was over. Today, my friend received a letter which states that he had a court hearing about the deficiency. They said he still owed about $11,000 for the difference between the loan and the price at auction. There is no way he can't pay the debt. What should he do since he doesn't have any money left?

Re: Question about court hearing of deficiency

there is one thing to get a judgment, there is another thing to collect.

If the judgment enters, there will be ultimately a hearing on his ability to pay.

Bankruptcy?

Consult a lawyer for the specific facts.
