A felony is any crime that is punishable by death or imprisonment in the state prison. All other crimes are misdemeanors. Since straight Assault & Battery, Chapter 265, � 13A, calls for not more than 2 1/2 years in the House of Correction or a fine of not more than $1000, it is a misdemeanor.

"Straight" A/B or "simple" A/B is a misdemeanor. Where the crime is ABDW (dangerous weapon) or Aggravated (like on a pregnant woman or elderly) it becomes a felony.
