I was the victim of a theft

I am a 15 year old student. I was a victim of theft of my personal property worth $300 on my schoolbus. With the help of my local police the case went to trial. The judge ordered restitution by the defendant by July 11, 2007. He is on probation for other charges combined with my case. As of this date I have not received any money. He goes back to court Aug. 8th and his probation officer tells me that if he goes to jail then I will not be paid the money I am owed. I was violated by this person. What is my recourse from this point? It may seem like a small case but I want restitution. I would greatly appreciated your HELP.

If he is sentenced to jail, most likely the restitution order will be revoked. You may want to go to court on that date and ask the probation officer if you could be heard by the judge in order to express your feelings on the matter.

If it is revoked then your only real avenue of redress would be a small claims case. But even if you win it it may be difficult in collecting the judgment.
