Legal Question in Family Law in Massachusetts

My 19 yr old son has cut ties with his father (we have joint custody) and has lived with me full time since this past summer. My ex is, on paper, the custodial parent, but he has provided zero financial support for my son since August. My son has definitely spent more than 50% of his time with me. Do I need to get a modification or can I just go ahead and claim him?

Without knowing the terms of your settlement agreement, you need to file for a modification and a contempt if your ex has not made child support payments.

You need to file a modiification. Until there is an order from the court that changes the order of custody you are still bound by the old order.
