Legal Question in Family Law in Massachusetts

capias

I have a capias in Mass. against ex husband for past unpaid child support and interest and penalties. My ex lives in Maine and has stated that he will not come to Mass in near future. Can I have the Sheriff in Maine serve him the capias and have him brought back to Mass? He has failed to show up for two court hearings since May 2006. Any advice,comments , soggestions would be appreciated Thank you

Re: capias

A capias can't be served outside MA. You should go to the Clerk's office of your local District Court with all the court documents that established the child support order and request their assistance with filing a Reciprocal Support action wherein the Court here will contact the appropriate court where he resides to have him brought in there to answer as to why he should not be held in contempt of court for not paying the support as ordered.
