Legal Question in Family Law in Massachusetts

Hurt Children

My ex, his girlfriend and her 17 year old son soon to be 18 have spreading some vicious lies about me and it came back from different people and to the children as well. My ex and his girlfriend talked to our children (ex and mine) about me and the things that were said confirming it was said and upsetting the children. When I told him that is not acceptable you can not do that he said he thinks it is fine. I do not and will not say awful things about my ex nor have I or will I ever have talks with our children about their father degrading him in any way shape or form. Is this acceptable in what my ex and his girlfreind has done to our children?

Re: Hurt Children

there are two impacts: one is the kids for which you can seek the court's intervention, and the other is a defamation action.

Re: Hurt Children

It is absolutely NOT acceptable to discuss matters of personal adult conduct with the children, whether or not it is true, unless it is necessary for the children's safety. Depending on the type of information being discussed, you may need to go into court to seek orders limiting visitation, or taking other steps. Unfortunately, these are hard situations in which to get fully effective enforcement of orders against disparagement -- but you should not refuse to try.
