Legal Question in Family Law in Massachusetts

My husband and I have lived in the same appartment for almost 9 years. We originally had a lease in both our names but it expired years ago and currently have a verbal month-to-month agreement. I am considering seperating from him. I am the only one who has had a job for over 30 months. He was not working steadily before that job ended. Can I force him to leave the house so we can seperate? I want to work toward resolution but need to see he had get his life together before we continue to live together. Neither domestic violence nor infidelity are at issue.

You may be able to force him out but only if you file for divorce or seperate support. The court has the power to make one of you leave if you file an action. The court also has the power to order alimony. Since you are the wage earner you could find that you are ordered out and have to pay him support.
