Legal Question in Family Law in Massachusetts

My ex husband is taking me to court to cancle child support he adopted my daughter 4 years ago and he has had custody of his biological son sense 2012 he is now trying to get child support canceled because he can not afford to get a place on his on for him and his son while paying child support I believe he is making 15$ and hour works 40 hrs a week but he hasn't seen his daughter in 2 years and hasn't help with anything but pay child support which he has stopped pay a couple times and he has been found guilty of contempt of court for not seeing his daughter. For the past 2 years he has been living rent free in federal housing with his gf they broke up and now he needs a place. What are te chances he will be able to get it dropped???

Child support is generally based on income, nor personal expenses. Expenses for his other child would more likely be factored in if you were seeking an increase. It's harder for him to successfully use that as a basis for a decrease. Nonetheless, you may be better off asking for an increase based on the fact that he rarely has the child, which results in a greater financial burden for you.
