Legal Question in Family Law in Massachusetts

I am currently paying child support for my daughter in MA, she is 19 years old and is now pregnant. She is not attending college and does not have a job. Must I continue to pay child support in this situation?

If she is "dependent" on (i.e. living with) the other parent, you may need to pay child support. However at age 18 the child support guidelines don't apply anymore, so judges have more flexibility and discretion on child support orders. These cases are very fact specific and you should get a consultation to determine whether you must continue to pay and get an idea of how much of a reduction you would get if you filed a complaint for modification.

I agree that these cases are incredibly fact specific, and that you should retain counsel to assist you. At a minimum, make a consultation appointment with an attorney in our office to review the facts an give you an opinion on likely outcomes and options. Based only on the facts that you have provided, you may be a good candidate for a modification of child support.
