Legal Question in Family Law in Massachusetts

My stepdaughter has been living with me and her father since she was 2. shell be 9 in November. her biological mom has been in and out of her life. shes a recovering addict. recently shes been seeing her every other weekend, with the help of her own parents., my stepdaughters grandparents. she wants to take us back to court . Because recently somethings happened with my stepdaughter when she was at her moms and the school emailed us. my husband wants to have our daughter not go this weekend with her mother so out of rage she wants to take ava away from me. do i have any rights. Recently my husband and i separated and our kids including my stepdaughter lives with me.

Unfortunately, you need to contact an attorney who specializes in custody issues. As a step mother you do not have a great many rights, however the court will act in the best interest of the child. You and your Husband need to get an attorney as soon as possible. There is no such thing as legal separation in MA, however as long as you and your husband are married I think you and he can assert physical custody of her. The only party you really need to be concerned about are the grandparents, who could also seek custody. I am not a child custody specialist.
