Legal Question in Family Law in Massachusetts

X wife says we owe 50% of a $70k 'college' loan she took out .

My husbands youngest son graduated from college 2 weeks ago. My husband has been faithfully paying his child support payments on time each week, plus sending money directly to his youngest son at college ($250.00 a month to help with expenses).

His x-wife told him, a week after the graduation, that she had taken out a $70,000 student loan and he owes half of it. She never told him about the loan and never discussed anything about him having to pay more than his weekly child support checks.

Is he legally obligated to pay half of a loan she took out in her name and told him nothing about?

The answer depends on the wording of the divorce decree (as modifified) or the separation agreement. You should take these documents to a lawyer for an opinion.

It depends on the contents of the divorce decree.
