Legal Question in Civil Litigation in Massachusetts

Forged Signature on Rental Agreement

My 19 year-old son rented a house. The landlord within 2 months called to complain about some issues.I told the landlord that I never wanted my son to rent since he was not mature enough, therefore I did not want to be involved. To my surprise the landlord tells me that I was responsible since my signature was on rental agreement.I told the landlord that it was not my signature, that I had never been asked to sign anything, and that he needed to go to court and address that issue with my son.Since my son moved out,I found out that the landlord claims damages of $1080 and that my wife signed the agreement, but that at the time she signed, the only other signature on the document was my son's. My wife believed that my son's girlfriend's mother would also sign, but wisely she did not.I want my son to be responsible for any possible damage to the house and for forging my signature.I am upset that the landlord never even talked to me to confirm that it was in fact my signature.I knew that my son would not be responsible and I would have told him so. Regretably my wife signed the lease. My wife did talk with the landlord at the time but there was never a mention of me or my signature. She knew that I would never sign.Is this lease legal? Thanks

Re: Forged Signature on Rental Agreement

The issue of whether the lease is legal is a very broad question involving a number of different factors. From your description, however, it appears that both your son and your wife may be on the hook with the landlord, as a result of signing what purports to be a valid lease. I strongly urge you to consult directly with an attorney, and that you show that person the lease and explain the entire situation, to get a better assessment of your rights and options.
