Non Disclosure of Sexual Orientation Prior to Marriage

My former husband was a sexually active homosexual prior to and during our 8 year marriage. I was unaware of his sexual orientation prior to and during the marriage and we had two children together. He was also emotionally abusive during the marriage. I was conned by this man, and the emotional, physical, and financial toll this experience(both the marriage and the divorce) has taken on me has been enormous, including hospitalizations for severe depression and constant court battles over custody of the children.

Do I have any basis for a civil suit against him?

Unfortunately, based on what you have stated, I don't see any grounds for a civil suit against your former husband, outside the context of the divorce proceedings. You may want to consult with your divorce attorney to see if there are any options in that regard.
