How can I recover money loaned to a friend?

I loaned $9,000 to my ex-boyfriend. He signed a loan agreement that he will pay me back according to my terms. However, when I try to discuss it with him, he is evasive. I also do not feel that he is capable of paying me back without a third party's intervention because he is not responsible with his money and is not making paying me back a priority. How can I get help recovering the money? Is going to court an option? What would the judge do? How much would it cost?

If he has signed a promissory note then that is your proof. This is the problem, you state he has no money! You can file in the District Court in the county you live in, he lives in or where the agreement took place. The filing fee is 195.00 and 5.00 for a summons. Then you need to serve the summons on him by the deputy sheriff of that county, which will cost you between 40-50 dollars. If you go pro se then you don't have to pay an attorney. Although, you may get a judgment, you are back to square one in collecting, if he doesn't have the money/assets. If he has assets, you can file a lien once you get the judgment. It is a long process. If there is anyway you can settle out of court you would be better off. But certainly 9,000 is not a drop in the bucket and you may have to go through the system. Even if he does not have the money now, if you have a judgment from the court you can collect on it at anytime. Good luck! Hope this is helpful. Sincerely, Maria Murber
