refund from dental services

I have been waiting for months for a refund from my dentist. I had extensive work done. My dental insurance says they owe me approx $2300.00 and they never return any calls and if they do they say that they are working on it. I have called they approx.25 times and when i asked to speak to the ceo the answer was i couldn't make an appointment or talk to the ceo until I talk to the billing person that never answers my calls. I'm not sure if I need a lawyer of if I have to take it to small claims court. I would appreciate any response. I wonder if the company if going something illegal because of the igoring my calls. thankyou

A failure to return your calls is not illegal.

My impression is that you have at least two choices.

1. You can send a 93A consumer fraud letter of demand, and then follow it up with an action in small claims court for $2,000; and/or

2. You can file a complaint with the dentist's board of registration.
