Legal Question in Immigration Law in Massachusetts

Hello. I am over 21, a Green Card holder and just applied for Citizenship. My parent is in US on a Visitor visa which expires in November 2011. After I will receive a Citizenship I want to petition for my parent to stay and live with me in US. However, I am afraid my parent's I-94 will expire before I will be a Citizen and will be able to file a petition for adjustment of my parent's status. Therefore, my parent will be considered illegal. So, my question is:

1. will I still be able legally file a petition for a green card for my parent while he/she is in US on expired I-94?

2. Is there any "Law punishment" or my parent will be forgiven for overstaying as an immediate relative?

What should i do BEST in my situation? How Can I legilize my parent while he/she is in US and we are waiting for my citizenship approval? THANK YOU so much for your answer in advance!

Hi,

Technically your parents can be sponsored and adjust status in the U.S. even if the I-94 has expired: www.h1b1.com/sponsor.htm
