Legal Question in Immigration Law in Massachusetts

K1: Divorce and remarriage to another party

My wife came to the US on a K-1 Visa. A year after their

marriage she got a divorce. She filed a I571 to remove the

condition on her green card. We've been renewing the visa

annually while it is pending. We I married last year, 1

1/2 years after the divorce. We sent copies of the

marriage materials to our account number at the USCIS

office. What do we need to do? Do I need to fill out a K-1

application for her? Do we just wait for the I571 to run

its course? Thanks for any help.

You may want to hire an attorney, on an hourly basis, to look into why the I-751 has not yet been adjudicated. This may prove more cost effective than refiling, as refiling will not resolve the pending I-751, and it will need to be addressed. If you would like assistance from my office, please contact me by telephone or email.

My best wishes.

You should consider filing a marraige-based petition for her on your own. Sending evidence of a new marriage doesn't do much for the present petition.
