Legal Question in Insurance Law in Massachusetts

need help on auto accident

Hi,

I was rear-ennded last Spring. I had neck and shoulder pain. But I did not seek medical treatment untile 6 month later because the pain was getting worse and worse. So about 1 month ago I started physical therapy per my primary doctor's request.

I filed a claim with the insurance company. They scheduled an appointment with a doctor to do an examination for me. I went see the doctor two weeks ago. He filed a report to the insurance company and concluded that the neck pain is unlikely related to the auto accident. So the insurance company sent me a letter saying that based on the doctor's judgement, they will not cover any medical bills related to my neck pain.

My question is: Dose the insurance company have very strong legal arguement so that there is no way I can seek any reimbursement from them?

Their argument is somewhat legally valid but if you press the issue you should prevail. If your company does not cover you, you could collect from the person who struck you.
