Legal Question in Employment Law in Massachusetts

Retaliation for Investigating a Sexual Harassment

I recently did my first sex. harassment investigation. Now, another manager thinks I'm not qualified to perform the investigation because of my past behavior in interracting with other staff. So, now MY supervisor is doing an investigation on ME to see if I have acted improperly.

Do I have any rights to protect me from what I perceive as harassment of me? I have done nothing improper, but my company is 87% female and I am a male manager and therefore an easy target.

Thanks.

Re: Retaliation for Investigating a Sexual Harassment

This sounds interesting. What kinds of things did you do while investigating the claim?

What are the things they are doing which constitute their investigation?

Did you receive training prior to doing the investigation?

How many employees in the company?

What is the nature of its business?

Of what department are you the manager?

What kind of claim was it: man-woman, man-man, woman-woman?

Repetitive harassment? A single event?

Et cetera.

You situation is somewhat unique. You did not say what behavior you are being accused of. In any event, an employer has a right and a duty to investigate any complaint of discrimination brought to its attention. If it turns out that the investigation was pure harassment, you may have a claim against your employer for slander or libel, but these claims are difficult to prove and would probably cost you your job.
