Legal Question in Landlord & Tenant Law in Massachusetts

Security Deposity

I just moved and recieved some of my deposit and letter from my old landlord. I don't agree with what she said and she kept some of my deposit, but I deposited the check. Does that mean I have no choices to despute what she said and did? I have no proof of what I believe to be true, so I don't think I have any legal choices, but is there any other way I can despute what she did and said? I am afraid that if I write her a letter she will say it's slander or harassment and have me arrested or worse I am afraid for my physical safety with this women. I feel I have no choices, any suggestions? Thank you.

Re: Security Deposity

You have a right to file suit for the return of your security deposit. You can do this via Small Claims. She will have to prove the fairness of what she withheld, and that she fully complied with the Security Law statute in all material ways. The statute allows for payment of attorney fees, and for trebling of improperly wittheld funds.
