Legal Question in Medical Malpractice in Massachusetts

Orthodontics Mishap

I got braces back in 1989 and got them off 5 years later. I recently visited a periodontist about getting an implant for a missing tooth and he informed me that due to my teeth being moved so much that I have little to no roots left in my front teeth and that they likely will fall out within the next 5-10 years. I am only 25 years old and will eventually have to have implants put in. Is it possible to sue the orthodontist that caused my roots to get so small?

Re: Orthodontics Mishap

If the Orthodontist failed to comply with the accepted "standard of care" in the dental profession, and caused you injury as a result, you would have a right to compensation, including damages for pain, suffering and future medical or dental expenses. In order to establish a departure from the standard of care, you would need the testimony of dentist giving his or her opinion that the standard of care was not met. I work closely with another malpractice attorney who is also a dentist. If you would like to discuss this matter in greater detail, you may call me for an initial consultation at no charge.

You could sue and win if you prove that dentist did something wrong or negligent or did not act like a prudent dentist in putting in your braces. Feel free to email me with further details.
