Legal Question in Personal Injury in Massachusetts

Slander

An ex-friend falsely accused me of sexually abusing her 3 year old daughter. She reported it to the Department of Social Services who, in turn, investigated. They found ''no reasonable cause to support the allegation'' and screened out the case. The problem is that she is telling people that I abused her daughter. Is there anything I can do to stop her?

You can file a civil action in either district court or superior court, for damages.

Re: Slander

Thank you for your inquiry.

From what you have stated, it appears that your "ex-friend" is engaging in defamation and, possibly, a number of other torts such as intentional and/or negligent infliction of emotional distress. To falsely accuse someone of sexual abuse is extremely serious. Your options certainly include suing in a court of law and, possibly, moving for some type of injunction to stop her from continuing to harm your reputation, among others. Determining the right course of action will depend on the details of your situation, what she is alleging, what DSS ultimately concluded and why, among other factors. One thing is certain, you should contact an attorney for assistance in assessing your options and, if you choose, taking action.
