Legal Question in Real Estate Law in Massachusetts

Mass property with a first / second / third (family member) and a credit card judgment lien in fourth position. There is a lot that can be split off from the property. The 1,2, and 3 positions are okay with giving a partial release to be able to sell the lot, so my question is: Is it possible to get a partial release from the credit card lien, it is a homestead property, or will that lien for 14K need to be paid off when the lot sells? Thank you for any help on this.

Thank you for your question.

If you are going to sell the property, all encumbrances, mortgage loans, and other liens will need to be paid off. Our office practices in the area of real estate purchase and sale, but can also assist in the negotiation and settlement of debts, if that is what is holding things up. A partial release is not going to be acceptable to a buyer. Office phone: 617-357-4898

It may be possible. But if you have a closing scheduled, the creditor who owns the credit card judgement will smell your urgency. I have removed these liens in the past: 617-230-2779
