Legal Question in Wills and Trusts in Massachusetts

Under the gun

Hello folks,I am a partial heir to an estate which has been sold,by the estate's executor, without the approval of the other co-heirs. I would like to know if there is anything that can be done to delay,or revise the sale of said properties,by myself or other co-heirs. Thank you...

Re: Under the gun

I assume you mean the real estate within the probate estate was sold. Was the executor authorized to make the sale? The term for the authority is "license" and is by no means automatic. Sometimes a will provides it, sometimes it is implied by law (but only rarely) and usually it is ordered by the court after an announced hearing to which you should have been "invited."

Why do you oppose the sale? That's a key question.

Give me a call if you like but I'd prefer you write back to me by e-mail. My e-mail address is [email protected] or [email protected] but you can also call me at (617) 527-0050. -- Stuart Williams
