Proving Violation of a Trust
My great aunt left an estate to my family, and enough money for any family member to live there, with a moderate rent. The tenant would have maintenance costs paid for. It was clear in the trust that all family members were to be able to use the house. In 25 years, nobody has been invited to stay or visit and I've recently hired a lawyer who thinks there are many violations in the implementation of the trusts. The trustees got lazy. My fear is that if we dont' pursue this now, this one family member will keep the house for himself. Which is not what my aunt wanted.
My question is we think that this tenant is renting out part of the house (valued around 6 million $) to subsidize his rent.If it's true, he's violated the trust and will be evicted. If he is collecting cash from this rentor and if there is only one phone line into the house, how can we find out if he's doing that, aside from surveillance? My lawyer says all information like that is helpful, and I'm trying to provide him with lots of information.

If you retained an attorney, you should be consulting and relying on this person's advice and counsel. If you hired an attorney, you should consult with them since you are paying for their counsel.
