Legal Question in Wills and Trusts in Massachusetts

I am a sole trustee for my brothers estates. He refuses to give me a copy of the trust. He owes me a large sum of money. I believe I am entitled to a distribution from that trust. How can I go about getting a copy of his trust ?

I think you mean you are personal representative of the estate. The trust is going to be needed by the Court at some point and if you are a beneficiary of the trust you have an absolute right to examine the trust. You may want to file a motion with the court asking him to produce a copy. You may also want to reach out to the attorney who drafted the trust. Most likely it is the same person who drafted other estate planning documents. Our office represents folks in your position as they administer the estate of a loved one.
