Legal Question in Appeals and Writs in Michigan

when to file for an appeal

My son was convicted by a jury trial with no evidence to csc-1 and I was wondering when do we file for an appeal? Do we do it at sentencing or before? And how long do we have to do this?

Re: when to file for an appeal

At sentencing the judge will explain the rights on appeal. You can file the appeal that same day. Chances are, he had at least a court appointed lawyer. Why didn't you ask him or her these questions?

Re: when to file for an appeal

After a conviction, the defendant has an automatic right to appeal. If he desires a cout-appointed attorney, he must file his request within 42 days of sentencing. The judge will inform the defendant of his appellate rights. He must have had a lawyer in his case who can answer all these questions for you.
