Legal Question in Business Law in Michigan

Business Name

I live in Michigan. I came up with a name for my new business and my searches did not find anybody else using it in Michigan. I also did not find a registered federal trademark nor did I find it through Google. Two weeks later, after I started setting up my business under that name, when I went to register the domain name for my website, I found someone else is, in fact, already using it in another state. If they are not registered in my state or with the FTC, can I proceed with using the name?

Yes. If they have not registered the business name in your state, you can register it and use it. If in doubt, contact a business lawyer who can do a more thorough search for you.
