Legal Question in Business Law in Michigan

Subpeona for documents

I moved to Mi 3 years ago and became a ''resident agent'' for a friend from Ohio who owns a business. The business is being sued and I have been subpeonaed to produce documents I do not have (financial recods of company, etc) I thought all I had to do as a resident agent is forward documentation to the company that I may receive in the mail. I had never received any papers until this suit. I truly don't know anything. As a matter of fact I have lost touch with the friend and have since quit being a resident agent by filing the appropriate paperwork with the state. Do I have to appear for the subpeona if I have nothing to contribute? It is over 200 miles from where I live. Should I get a lawyer? Can I be sued as the former resident agent? any advice?

Re: Subpeona for documents

You should respond in writing to the person who issued the subpoena informing him that you do not have possession of the information requested and give him the contact information for the owners/managers/members of the entity. You should also immediately forward the subpoena to your friend, if you haven't already.

If you don't respond to the lawyer, he will have no idea why you are avoiding him, and will likely request a show cause hearing, thus creating more problems for you.
