Legal Question in Credit and Debt Law in Michigan

Credit Purchase

We purchased two air purifier systems from Oreck Direct in April of 2006 on our American Express card. American express paid four payments then closed our account. We had forgot about the automatic payments coming out of American Express. We did not recieve a bill from Oreck until February 2009 asking for $341.51. I called so they would not take us to collections and then sent them 41.51. After checking and verifying the amount owed I am questioning the amount of time it took them to send us a bill and threating to send us to collections. We would have paid it much sooner if they had notified us. What do we do?

I would recommend just paying the bill. If you think the amount is incorrect, then dispute it, but it isn't their fault if you forgot that you were set up for automatic payments. At the same time, they should've sent you a bill as well, but without reading the payment agreement that you signed when you purchased the product, I wouldn't know if they were actually legally obligated to pay you.
