Legal Question in Credit and Debt Law in Michigan

family created credit card fraud

I applied for a t-mobile phone in may. I was told i already had a account there. I got a free credit report from that and found out i had several items on my credit report i wasnt aware of. T-mobile deemed my account a fraud. Next on my credit report was 2 credit cards. Both were created a month before my 18th birthday. On the account i was listed as primary account holder with a my mom's name on the account and some unknown man. Captial One deemed one of the accounts fraud. and the other account with my mom's name on it as secondary account holder was not deemed as fruad. they told me i was resonable for it. i talk to my mom and she says she has no knowledge of it. i believe she opend the account in my name when i still under age. How do i go about getting the account taking off my credit report. Capitol one is holding me responbile for a account my mom created in my name when i was 17. im now 21.

Re: family created credit card fraud

I do not know which credit bureau you received your report from, but there are three main ones: Equifax, Experian, and TransUnion. Each company has a website with instructions and contact information for report disputes. You should follow the instructions on the sites to make a dispute. Make sure you send in supporting documantation if available and as necessary. If you were not a cardholder but just an authorized user on the Capital One card you are not responsible for the debt and it should not be reported as such. Also, if you were an accountholder but were only 17 at the time you may be able to avoid responsbility for the debt based on your age (assuming you didn't create more debt on the card after you turned 18).
