Legal Question in Credit and Debt Law in Michigan

can they garnish wages for a credit card?

I had a credit card and was able to keep up payments. When the income dropped I couldn't keep up the payments in a timely mannor and finally just quit paying all together. A lawyer bought the debt and proceeded to sue me for it. He told me he realized that it was something that should never have been pursued in the first place but he had to have so much for his costs before he could get out of it. I told him I don't have any extra money but agreed to send what I could until his money was met. But I was going to the dr so much and trying to keep up with that I couldn't pay him and honestly forgot all about it with everything else I have going on right now. Now I get a request from payroll to setup a garnishment from him for 25% of my pay. Problem, I will not be able to pay rent or car. Is this legal to garnish for a credit card? Is there some kind of finacial help or hardship plan that can help me? I can't afford to do bankruptcy.

Re: can they garnish wages for a credit card?

A creditor may legally garnish your wages based upon a valid court judgment. The source of the arrearage is not relevant. However, you do have the option of asking for a court-ordered payment plan which would stop the wage garnishment.
