Legal Question in Credit and Debt Law in Michigan

Judgement didnt know about?

I just received notice that a Company in Michigan has renewed a judgement against me that I didnt know existed. They told me that it has been renewed for another 20 years? They say that they are calling from the orginal creditor: Credit Acceptance Corp. I haven't even been in Michigan for 17 years, I did get a car there. My X was left with the car in 1990 when the kids and I had to flee California due to his involvement in drugs... When I divorced him legally in 1992, he was given all debts from the judge due to his actions. I was never notified about a judgement, so what can I do?????? I don't feel that I owe this, I thought it was paid long ago??? But being in the relationship I was in back then, I don't really know? Can you help?

Re: Judgement didnt know about?

You should know that any agreement or even a court order assigning the indebtedness to one or the other of you or your husband, unless the creditor was made a party to the proceeding or agreement, is not binding upon the creditor. It may well be that you have a claim against your ex for whatever the cost it will be to take care of the judgment, or get him to handle it for both of you. Keep track of it, however. A judgment that old can probably be settled for a substantial discount.

Re: Judgement didnt know about?

Even if your ex-husband assumed responsibility for the debt in your divorce, a creditor can still pursue you (if your were a party to the obligation) because the creditor was not privy to the divorce proceedings. It is unclear from your question which, if not both, of you signed the auto contract. Judgments in Michigan are renewable every 10 years. Also, for a valid judgment to have been entered against you, you would have had to have been properly notified of the lawsuit on which the judgment is based.
