Ordered Merchandise Never Received

Hello. I ordered $800 worth of electronics from a local computer company about 5 months ago. We were supposed to get the items in late December, but the owner of the business kept saying that due to a recall on the products they were in short supply. This was partially true due to the high demand of this product, but now it is readily available. In my last contact with him a couple days ago, he said that he had emailed me a month earlier and did not get a response from me. I received no such email. He also said that since I didn't reply back that he sold my order to somebody else. I had already payed for the item, so I think that him selling my items after not getting a reply from me through email (he has continuously said he'll call my cell when the products came in) is rediculous. He does not answer my calls anymore after I asked for a refund. I do have a scan of the cashed check provided by the bank and a receipt of the order. What can I do to get my money back?
