It is possible during the plea bargain process (depending on the facts, his criminal history, and the particular prosecutor office). A skilled attorney can put him in a good position for a possible plea deal. Feel free to contact me to discuss for more information.

It is always possible to have it dropped to that or something lower, especially if he has limited or no prior criminal history. The main thing is to not only a void a felony, but to avoid a traffic-related misdemeanor, like any fleeing and eluding charge, because 1) it cannot be expunged, and 2) it has mandatory driver's license sanctions. Get an experienced criminal defense attorney on board ASAP to review the police reports and videos. Together, you can discuss you options, possible defenses, and likely outcomes so you can choose the best course of action to take.
