Legal Question in Criminal Law in Michigan

Entering a plea

Daughter was charged with Posession of Marijuana in Michigan, now she is living in Florida with us, her family.

Can she plea to these charges by any means other than her having to go back to Michigan? She has no money, doesn't want to return to Michigan either, no where to stay, no family there and again no money. Can you help me in finding a solution?

Re: Entering a plea

Send me the name of the court, offense date, age and prior record (if any) of your daughter, and whether she notified court of her departure.

Given the right circumstances, she may be allowed to plea by mail.

Re: Entering a plea

An attorney can usually enter a plea on her behalf, especially since she is out of state. Do you have an attorney and/or does she qualify for a court appointed lawyer? The court may also be able to handle the proceedings via videotape, depending on the court and whether it has these capabilities. I suggest you retain a criminal lawyer as quickly as possible.

Re: Entering a plea

This is a criminal matter which requires her personal presence. However, she may be able to return to Florida during pending court proceedings if she has an experienced attorney by her side.

Re: Entering a plea

Michigan does not have a plan whereby people can plead without appearing in court. However, it might be possible to explore other options. Have her phone us for a free, initial phone consultation at 1 8667665245.
