Insurance Claim

My car was stolen 05/30/2009. Due to the circumstances, the insurance company would like me to make a statement under oath. It has also come to light that 9 months ago my husband submitted a claim that was false. Now the insurance company is investigating both of us. I resended my claim becuase I feel as though I am going to pushed into confessing something that I did not do. Is there a law that says I have to give the sworn statement under oathe

If you want your claim to be considered by the insurance company, your policy allows them to get this EUO (Examination under oath). If you refuse, they will simply deny your claim. This is a catch-22 of sorts. Please visit www.kliszlaw.com to discuss. Tim Klisz

The statement under oath is not pursuant to law but it is by contract. That contract is your policy. Therefore, you will need to attend the statement under oath if you wish to pursue the claim. Do not let the insurance Company intimitade you. You can certainly hire an attorney to accompany you. Most of the time, insurance Companies have their attorney present with the adjuster; so you should too, especially considering the circumstances. What kind of claim?
