You can file all the necessary paperwork with the court by mail and the necessary parties. However, you will have to appear in court in person before the judge for the hearing on your motion. If you are considering an expungment, do not attempt one without the assistance of a lawyer. It's more cumbersome and tedious than you think. Also, if denied you can't petition again for another three years.

Get a copy of your Michigan IChat criminal history report and have a consultation with a lawyer to determine if you are eligible. You would not believe the number of people that have come to me thinking they were eligible for an expungement only to find out they weren't.

Any minor misdemeanors like disturbing the peace, MIPs, and traffic convictions can affect your eligibility. Charges that went through a special diversion statute such as 7411 for drug convictions or Holmes Youthful Trainee Act (HYTA) count as convictions for purposes of expungement eligibility.
