Legal Question in Family Law in Michigan

Can benefits for children provided by ex-spouse's employer at no cost be cancell

My ex-spouse's employer provides benefits including

medical, dental and scholarship programs to the children of

employers or their eligible surviving spouse until age 25

if still a dependent of either. My ex-spouse cancelled benefits for our son, who is nineteen -- in college-- and

a dependent of mine. He has denied scholarship monies that

would increase his gross income even though I believe taxes

would be taken from amount before submitted to college. I am willing to let him take the amount of scholarship off his income for child support purposes. He mentioned scholarship in petition a year ago and then refused benefit. My ex-spouse keeps taking me to court over frivilous things. He and his new wife work for same auto

company that provides legal plan--under her so does not show on his w-2. I would like reimbursement for time and

mileage and at least half of my legal fees--Is this possible? Also ex-spouse given opportunity to chose from

three medical plans each year at no cost. PPO available in

my county where children live. He chose HMO not available in my county and has court order if I don't use his doctor

that is 30-40 miles away one way and would take I guessing 3hrs away from work. Time and mileage?

Your ex-husband's obligation to your children is strictly governed by the terms in the divorce decree or any orders interpreting that judgment. For more info, please contact my office at (248)851-3171.

You have lots of issues. You may get attorneys fees depending upon your income versus his but don't necessarily count on it. Get a lawyer that does quality work that you can afford that is very familiar with the family law practices in your county. William S. Stern
