Legally Removing a Spouse

If a spouse willing left 3 days ago and has not returned, can I legally change the locks on the apartment even if he is on the lease. He has been using drugs and I'm concerned about my children's and my own safety. What exactly must I do legally?

File for a protective order, change the locks, but he is entitled to live there if he is on the lease, unless you have a court order of separation. Keep his stuff safe.

You can legally change the locks. He can legally break in. If you want to prevent that, ask your attorney to obtain a court order.
