Legal Question in Civil Litigation in Michigan

Breach of Contracts

We, meaning my business, were called by a customer to build a sprial staircase for their home, 30 miles away. We went out and met with the homeowner and his builder 3 or 4 different measuring, discussing different aspects and different accessories and options with them. We made numerous calls to our distributor pertaining to this order. The customer agreed to our price, gave us a deposit, signed our contract and we proceeded with the order. Eight days later, the homeowner called us on the answering machine and told us he wanted to cancel the order. What is the Michigan law about breach of contracts in an Unsolicited contract and returning of their deposit?

Michigan contract law is pretty much the same as in other states. There has to be mutuality-that is each side is agreeing to do something of benefit for the other. There also has to be a meeting of the minds. Sometimes it has to be in writing. The written contract in your case is important in determining whether you are entitled to recover and how much.
