Are discovery documents (exhibits) considered confidential within the timeframe that a lawsuit is going on.

You can make them confidential but to do so requires a special court order. I guess that it could be argued that disclosure of medical issues should only be limited to the other lawyers but the reality is that if the case goes to trial, those matters are submitted into evidence and argued in an open courtroom for anyone to hear so how confidential could that be? The reality is that when you file a lawsuit, you are giving up a great deal of your privacy. It's a shame that the party who has already suffered enough endures more suffering because of this reality but that's life. William S. Stern
