Legal Question in Civil Litigation in Michigan

What do I do about fence damage from a snow plow?

My property backs up to a commercial building. Last summer I had to replace my privacy fence that lines that back of the property. The business behind me hires a snow plow guy to plow the lot. He has pushed the snow so high and hard against the fence that it is now bowed , split and coming forward into the yard. I have tried talking to the business owner with no luck. I called the police and they told me it was a civil matter. What do I do next? I am not paying to have that fence replaced again.

thank you, G

It sounds like you need to sue the property owner and/or the snow removal company. If the damage is less than $3,000, you can sue in small claims court (where the parties represent themselves). If the businesses are corporations or limited liability companies, you will need to bring the action in district court since corporations and LLC's must be represented in court by an attorney.

Good luck. Feel free to call me if I can assist you in litigation for my usual fee.
