Legal Question in Civil Litigation in Michigan

Ownership of dog

I had asked a former friend to hold on to a Import dog for me and train it. Papers have never been signed over to that person. I had asked her to return Dog to me for the past 4 month, Dog is now 7 moth old. She is claiming the dog was a gift to her from me. Dog papers are still in my name. I also maintained vet bills. Person is now refusing to return the dog. Dog is supposed to be used and trained for future police k-9 or personal protection dog. Paid for him 1500.00 dollars to import from Germany to US. Dog now values about 3500.00 dollars. Import pedigree, money bank transfers are all still in my name. What are chances to get my dog back?

Now it is going in front of the judge. What are the odds for this to end up in my favor?Could the judge still reward me the dog?

Re: Ownership of dog

Probably not what you want to hear, but...

If she has now had the dog for approximately a year and a half, I very much doubt you will get the dog back. The dog has been her pet for virtually all its life. I also doubt the court will order the dog to be neutered.

As for whether the case will end up in your favor it depends entirely on what you expect to get out of the case. My guess would be that you might receive the initial investment of $1500 (and of course, you might receive less.) I doubt you would receive more. I would have taken the mediation award if it had been me (too much hassle, time, costs, etc., for an extra $500.) Unfortunately, you may lose entirely if the court believes her story that the dog was a gift. At that point, you may even have to pay her court costs because you rejected the mediation award.

Good luck!
