Being sued in Small Claims Court

An in-law is sueing me stating that he has property at my house even though they never lived there. To my knowledge there is nothing and he is just harrassing me. How can he win with no proof what-so-ever? Can I counter sue for harrassment?

Whether or not the in-law lived at your house is not the question. The question is, do you have something that belongs to him? If so, simply give it back and ask for dismissal of the lawsuit without an award for fees or costs. If not, then when you respond to his lawsuit, you do what's called a "counterclaim." In the counterclaim, you ask for attorney fees and out of pocket costs for his having brought a frivolous lawsuit in the event the court sides with you. Good luck!
