Legal Question in Health Care Law in Michigan

second hand smoke

We live in a condo, and are constantly smelling our neighbors cigarette smoke. If the smoke outside on their porch, which connects to our porch it comes in the window. If the smoke in their basement, which is connected to our basement it comes through our vents and aie-conditioner. What, can we do to stop this?

Wow - an issue that involves tort, healthcare and landlord/tenancy issues. First start with your landlord - the condo complex manager and tell him that you are entitled to quiet enjoyment of your residence rented from the complex. Then tell him that you are concerned about your health. Hopefully it will work. If not then you can always file a complaint and allege nuisance. But make your case ripe first by going to manager.

I am assuming that this is a rented place. If not then you need to negotiate with neighbor. The nuisance angle is always there. Good Luck
